This Giveaways, Competitions & Promotions Policy explains how New Horizon Code PTY LTD, including its products, services, applications, brands, and trading names, conducts giveaways, competitions, promotions, prize draws, referral campaigns, social media promotions, and similar campaigns.
In this Policy, “we”, “us”, and “our” means New Horizon Code PTY LTD and its related products, services, applications, brands, trading names, and product accounts.
This Policy applies to promotions conducted by or on behalf of New Horizon Code PTY LTD, including but not limited to promotions for:

2. Purpose#
We may run giveaways, competitions, prize draws, promotional offers, referral campaigns, or social media promotions from time to time.
This Policy explains the general rules that apply to those promotions, including eligibility, entry requirements, prize conditions, winner selection, privacy, moderation, and our rights to cancel or amend a promotion.
Each promotion may also have its own specific terms, including opening dates, closing dates, prize details, entry method, eligibility rules, and winner selection process.
3. Relationship with campaign-specific terms#
Each giveaway, competition, or promotion may be subject to additional campaign-specific terms.

- submit a valid entry during the promotion period;
- are not prohibited from entering by law.

Employees, contractors, directors, officers, suppliers, agencies, and immediate family members of New Horizon Code PTY LTD may be excluded from entering unless the campaign-specific terms state otherwise.

We may reject entries that are incomplete, late, duplicated, automated, fraudulent, misleading, inappropriate, unlawful, or inconsistent with this Policy.
7. No purchase requirement unless stated#
Unless campaign-specific terms clearly state otherwise, no purchase is required to enter a giveaway or competition.
Where a purchase, subscription, or paid plan is required to participate in a promotion, this will be clearly disclosed in the campaign-specific terms and must comply with applicable laws.
We will not make false or misleading claims about prices, prizes, offers, benefits, product features, availability, or promotion conditions. Australian Consumer Law applies to social media advertising and promotions, and businesses must not make false or misleading claims.
8. Promotion period#
Each promotion will run for the period stated in the campaign-specific terms or promotional post.
Entries received before the opening time or after the closing time may be invalid.
We are not responsible for entries that are delayed, lost, misdirected, not received, corrupted, inaccessible, blocked, removed, filtered, or affected by platform issues, technical faults, outages, internet failures, or user error.
9. Prizes and offers#
Prize details will be stated in the campaign-specific terms or promotional post.
Prizes may include items such as:
- gift cards;
- subscriptions;
- service credits;
- account credits;
- merchandise;
- discounts;
- free access periods;
- product upgrades;
- consultation sessions;
- event tickets;
- digital products;

Prizes are not transferable, exchangeable, or redeemable for cash unless we expressly state otherwise.
We may substitute a prize with another prize of equal or greater value if the advertised prize becomes unavailable for reasons outside our reasonable control.
Any taxes, fees, travel costs, internet costs, device costs, insurance, setup costs, or other expenses associated with accepting or using a prize are the responsibility of the winner unless stated otherwise.
10. Winner selection#

For games of chance, winners may be selected randomly from all valid entries.

If a winner does not respond within the timeframe stated in the campaign-specific terms, or within a reasonable timeframe if no timeframe is stated, we may redraw, rejudge, or select another winner.
12. Public winner announcements#
By entering a promotion, you acknowledge that we may publicly announce winners using details such as:
- first name;
- surname initial;
- social media username;
- business name;
- state or territory;
- submitted entry;
- winning comment or content.
We will not intentionally publish sensitive personal information as part of a winner announcement.
13. User-generated content#
Some promotions may require entrants to submit content, such as comments, photos, videos, testimonials, screenshots, captions, designs, reviews, feedback, or other materials.
By submitting content as part of a promotion, you confirm that:

14. Prohibited entries and conduct#
You must not submit entries or engage in conduct that is:
- fraudulent, automated, fake, or misleading;
- generated through bots, scripts, fake accounts, or bulk entry tools;
- abusive, threatening, harassing, discriminatory, or hateful;
- sexually explicit, graphic, obscene, or otherwise inappropriate;
- defamatory or damaging to another person or organisation;
- unlawful or encouraging unlawful conduct;
- infringing intellectual property rights;
- invasive of another person’s privacy;
- impersonating another person, business, or brand;
- spam or unauthorised advertising;
- designed to manipulate, disrupt, or unfairly influence the promotion.
We may disqualify any entrant who breaches this Policy, breaches campaign-specific terms, tampers with the entry process, acts dishonestly, damages our reputation, or attempts to gain an unfair advantage.
15. Social media platform rules#
Promotions conducted through social media platforms are also subject to the terms, policies, community standards, and promotion rules of the relevant platform.
This may include platforms such as LinkedIn, Facebook, Instagram, TikTok, X, YouTube, Threads, Discord, Reddit, or any other platform used for the promotion.
Unless expressly stated otherwise, our promotions are not sponsored, endorsed, administered by, or associated with any social media platform.
By entering a social media promotion, you release the relevant social media platform from liability to the extent permitted by law.
16. Third-party prizes and partners#
Some promotions may involve third-party prizes, sponsors, suppliers, partners, or service providers.
Third-party prizes may be subject to the third party’s own terms, conditions, availability, expiry dates, warranties, policies, and restrictions.
We are not responsible for any act, omission, delay, failure, product defect, service issue, cancellation, refusal, or change made by a third-party supplier, except to the extent required by law.

We are not responsible for technical issues that affect entry, participation, communication, winner selection, or prize delivery.

- account restrictions;

- delayed messages;
- email delivery issues;
- broken links;

- device issues;

If a technical issue materially affects a promotion, we may modify, suspend, cancel, redraw, rejudge, or extend the promotion where reasonable and lawful.
20. Changes, suspension, or cancellation#

22. Liability#
To the maximum extent permitted by law, we are not liable for any loss, damage, cost, injury, delay, disappointment, or claim arising from or connected with a promotion, except where caused by our negligence, breach of law, or where liability cannot be excluded.
Nothing in this Policy excludes, restricts, or modifies any rights you may have under applicable consumer protection laws that cannot be excluded.
